Advice needed - ILR SET (O) Form

Post by Socia_butterfly_29 » Sun Jun 29, 2025 1:25 am

Hi,

I'm filling my ILR application and needed some advice. For context, I'm on a skilled worker visa since 2020 and am eligible next month (I submitted my initial Tier-2 application on the 10th of August and got it approved in November 2020).

As I was filling the form, I got confused about this question:

"When did you first enter the UK? This is the date you entered the UK when the period of stay you are basing this application on started."

So I was on tier-4 visa, up until August 2020, and initially entered the UK in September 2017 and from September 2019 till 2021 I was continuously in the UK. As I mentioned I made the application on the 10th of August 2020, but it got approved in November 2020. What date should I be using:

- September 2017 (when I first entered the UK on my student visa)?
- September 2019 (when I entered the UK after which next year I made my application for Skilled worker visa)
- August 2020 (when I submitted my skilled worker visa)
- November 2020 (when I got my first BRP approved).

Any advice would be much appreciated.

Many thanks.

The answer to that question has no bearing on your eligibility. You can enter the very first date you entered the UK. Again that date is irrelevant for ILR

Oh alright, thankyou so much Zimba.

Also, given that I applied on the 10th of August, 2020 for my first skilled worker visa and I was allowed to work from that point onwards, due to the unique rule in place for 2020-Jun-21 applications am I correct to understand that I'm eligible to apply from the 13th of July onwards?

The qualifying period is counted from your first visa application as per COVID concessions in place. The 28-day concession means you will be eligible for ILR (i.e. ILR can be granted) within 28 days of completing your 5 years. The date of ILR application is also largely irrelevant.

Applicants can benefit from the date of the ILR decision
