I want to apply for indefinite leave to remain but I don’t know in which category i should apply under.
I have been in the UK for almost 7 years i came in February 2004 as a student and i graduated in June 2006 and graduated with a science degree from London met university.
I applied for a science and engineering graduate scheme and i was granted one year leave to remain from may 2007.
I started full time employment in November 2006 and I applied for a tier 1 (General) in May 2008 and i was granted three years in February 2009.
I got married to a British citizen in September 2008 at a registered Islamic charity (Mosque) with the presence of two witnesses and fulfilling all the UK marriage requirements i also have a stamped and signed marriage certificate as proof. I have been living with my wife since then and have all the evidence to support that.
I have never stopped working since November 2006 and i am able to support myself and my family without the help of the government (my wife also works).
As i am approaching my second year of marriage and fourth year working and paying tax in the UK. i don’t know where i stand as far as indefinite leave to remain is concerned.
I would really appreciate your advice and help on if i am eligible to apply for indefinite leave to remain on the grounds of marriage or working in the UK for 4 years in the UK.
I also wanted to know if working under the science and engineering graduate scheme will count towards the time I’ve worked in the UK.

If your marriage was recognised, then you may switch to FLR(M) and subsequently apply for SET(M).

You may also remain on Tier 1 and apply for settlement after completing 5 years. Unfortunately, time spent under science and engineering graduate scheme will not count towards this five years (as this category is not included in 245E). However, it will count towards the ten years requirement, if you apply for ILR under Long residence.
