Work permit - Tier 1 - Extension vs. Tier 2 to obtain ILR

Post by ismile2u2 » Wed Mar 30, 2011 7:24 pm

Found some amazing answers on this website and really want to thank people who have helped me so far!

I hope someone can answer my question:
I came to the UK on Work permit in 03/08/2006,
then in May 2008 switched to Tier 1 general and was on that visa since.

Due to late start of my current job last year end Sept 2010, I was unable to earn enough points from my Salaried employment so had some additional funds from financial consulting on a self employment side (sole trader).
Money were received on a business account and I have been paying NI for the income earned in the current company registered, (overall have been registered with HMRC for 3 years now but with some other business though).

Because I've seen a lot of issues with self employment issues, on this site, I've requested my employer to sponsor me for a Tier 2 visa. They are happy to do that, however now the question is whether I will be able to obtain my ILR this coming August, should I have the change of status from Tier 1 to Tier 2.

So dilemma is applying for Tier 2 after April 6, 2011, or hire a lawyer (consultant) to apply for Tier 1 extension so that I can get an appointment in person to resolve, this prior to my current Tier 1 running out.

Also, read here that the age limit seems like now doesn't really apply because the age I've applied for Tier 1 initally will be taken as the age in question. Do I enter that age in the current application form then or no? (http://www.immigrationboards.com/viewtopic.php?t=74830)

Any comments will be much appreciated! Thank you very much in advance! :)
