Need a Help and advice for ILR

Hi Friends,
I have visa gap in 2009 for about 3 months because wrong application form was submit by my solicitor and home office send our application back and advice to fill correct form before to expire my visa but my solicitor was fail to send it in time and he send after visa expire (as i m on 3 years work-permit from 25 May 2006 to 25 May 2009 but i got my visa on 1 spet. 2009 to 1 spet. 2011 on tier2 general category for further more than 2 years) and there is no gap in my employment with same company and employ ,

My question is can I apply ILR in MAY 2011 or not or when i can apply for ILR please advice
