NO JOB for 3month in jobs for last 4.5+yr. Can I apply?

I came to the UK in May 2006 and was in job till Dec-2010. I am getting the qualifying points (as per PBS) with the income I have till Dec-2010 and satisfying all other criteria.

In my earlier post dr. watson mentioned that I can not apply, but I talked the the immigration (ukba) this week and they told me that I can apply. But they did not mention anything on whether my ILR application will be approved?

Bit confused..

Can some senior moderator PLEASE look into my case. I am eligible as of date for ILR.
