Hello everyone, I will like to ask you guys for advice.
Here it goes .... My wife is Italian and she is 24 years old. She moved to the UK in 1999 and lived in the UK until mid 2009 when she moved to Costa Rica to work for her parents who started a business here.
She did High school and University in the UK and also worked for many years at night in restaurants.
We got married here in Costa Rica Last year and now she is not sure whether she wants to stay here in CR for another 6 months or if she should go back and do a masters in the UK.
We have joined this Forum to ask you for advice on the following :
We know that because she lived in the UK for nearly 10 years and being an EEA National she should now have a permanent residence in the UK. Although she has never applied for any papers to confirmed so.
We believe she has a permanent resident and what we are trying to avoid is for her to lose this status if she stays here and does not go back to the UK in August. SINCE ACCORDING TO what we´ve read she can not be outside the UK for more than 2 years.
So please if anyone can advice us on this it will be of great help. The idea is that she does not lose this Permanent residence status.
If she does go back before the 2 years are up . For how long would she have to stay in the UK for her to keep her residence and then come back to Costa Rica?!

After talking to the UKBA site they told me that even if she did lived in the UK for 10 years it does not mean she is a permanent resident BECAUSE she did not apply for it. CAN anyone confirm this please ?
