Hi,

I arrived 4 months (or 118 days) late in UK after getting the initial visa. I applied for an extension and got an approval. We get a 3 month grace period while applying for ILR but in my case I was short by 4 months.

My visa was supposed to expire on 1st Feb 2010 but UKBA delayed the decision and I got an extension from 25th Mar 2009 to 24th Mar 2012.

My question is: Am I eligible to apply for ILR?

I was covered by section 3c during 1st Feb 2009 - 24th Mar 2009 so the total gap period is only 2 months now (59 days). Would this make me eligible for ILR??

Are you saying that on 24/03/12, when your current leave expires, you will be two month short of completing 5 years stay in UK?
If so, I would say you can apply and it is at the discretion of CW to grant ILR.

Yes I am saying that I would be short of 5 yrs by just 2 months. Initially the shortfall was 4 months but due the delay by UKBA I now have only a 2 month gap.

I Hope that would ensure that I qualify for the ILR.

Seniors, Please let me know your thoughts.

I would definately give it a go; hopefully the "case worker discretion" will work in your favour.

least thing you can do is apply a week b4 not 28 days so you cover 1 more month. cause 3-4 days it will take to go to case worker i beleive.

or go to PEO and explain there...
