Hi All,

I arrived in the UK in Aug 2007 on a Work Permit. In December 2007 I changed my status to HSMP, and in December 2009 I renewed under Tier 1 until December 2012.

My question is as follows:

As I entered the UK in August 2007, would I be able to get ILR in August 2012 despite my current visa not expiring until December? It is written on the UKBA site that one can only apply less than 28 days before the expiry of my current visa,

Please do not send us your application more than 28 days before the end of your qualifying period.

which is 5 years for you.
