ILE on Durable Relationship

Can one (non EEA partner) apply for ILE on the bases of Durable Relationship (unmarried partner of British Citizen) living together outside the UK for more than 4 years?
You won't be granted ILE if you have not passed the KOL test, but a settlement visa can be granted on the basis of your situation, and you may then apply for ILR from inside the UK after you have passed the KOL.
