Hi guys,

I was hoping if you would kindly help me with my immigration position.

I have a work permit dependant visa (with my mother the main applicant)until April 2013. I arrived in the UK in August 2008 and have been living with my mother ever since.

My mother applied for ILR herself and was granted ILR in 2009. She is now a British Citizen.

My question is: can I apply for ILR on my visa even though my mother is now British? If I can't apply now, when am i able to apply to settle in the UK? What other options are open to me?

Many thanks for your kind help.

Why didn't you apply for ILR with your mother in 2009?
You may apply for ILR if you satisfy 198.

Sorry to bump this thread to the top after such a long time.

The problem i have is that i am 22 and on my work permit i am listed as a dependant of my mother. I received my visa when i was 18.

Could i still apply under 198? If not then what are my options? Although i have a visa until April 2013, I don't want to leave anything to chance.

Thank you

So, on this day (today) are you staying in UK on the basis of a work permit issued to you? When was this work permit issued to you?

Are you married or leading an independent life?

@ sush

Am I correct in thinking that if at the present time he is on his own work permit, as he seems to indicate, then he does not qualify anyway. Because when he applied and got work permit, he stopped being dependant on his mother, and now cannot rely on his past dependant status.

I think the OP meant to state "on the vignette in my passport I am listed as dependant of my mother (WP holder)".

As @sush states i am listed as a dependant of my mother who was the WP holder. Although she now has a British passport.

I am unmarried but I am still living with my mother and dependant on her
