ILR Application - Clarification Please

My wife is due to apply for her ILR along with our daughter.

We will be using the Settlement Checking Service but the information regarding when we can apply seems to be a little confusing.

Perhaps I am just being a bit thick! :D

With regards to applying I know that they must both have completed the 2 year probationary period. That's done!

BUT ...

According to the Authority where we intend to do the Settlement Checking they state on their website that you must make an appointment no later than 28 days before the expiry of your permit.

That doesnt make sense to me. Surely as long as you apply before the end of your visa, that's all that matters?

Their visa expires end of July and we intended to make the appointment for the beginning of July (about 23 days before expiry). That's ok right? Or do I have it wrong? Does it have to be more than 28 days before the expiry date?

No earlier than 28 days before the 2nd anniversary of the date of entry in the UK as spouse of settled person.

So basically assuming we have met the 2 year probation period rule, applying 3 weeks before the expiry date of the visa is ok?

It doesn't HAVE to be more than 28 days before the expiry date. That's what I'm getting at.

That’s correct SgtBellPepper. It can’t be more than 28 days, but it can be less than 28 days before the 2nd anniversary of the date of entry in the UK as spouse of settled person.
