Tier 2 holder and ILR

Hi,

My name is Brian and I am currently working in the UK under Tier 2 General. My Tier 2 leave to remain starts from 31/07/2010 and expires on 01/08/2013. I also have 2 year Post-study Tier 1 visa.

I first came to the UK on 23/09/2003 under Student Visa and I want to apply for ILR as a long-term legal resident (10 years). This mean on 23/09/2013 I will meet UKBA requirements.

Could you please let me know if I can apply for ILR on 01/08/2013? Or I have to extend my Tier 2 visa first and then apply for ILR after 23/08/2013 (1 month before my criteria met)?

Is there any alternative way I can do so that I don’t have to extend my Tier 2 visa but still can apply for ILR?

When is the earliest time I can apply to extend my Tier 2 visa?

You can only apply for ILR no earlier than 28 days before 23 Sept (therefore eligible from 26 Aug), so you will have a gap and you will have to extend your current leave.

You might consider applying for an extension and then varying if the decision is not out before 26 Aug).
