Entry Clearance Date/ ILR ON WORK PERMIT

Dear All,
Please I need some urgent help as I have booked my appointment for my ILR at PEO office Sheffield on 8th July & I am very confused because of my dates for ILR. I am on commercial work permit and never been changed other category.
My Entry Clearnace was issued on: 03/07/2007
I Entered into UK: 16/08/2007
Difference of total: 43 Days
Got Promotion in December 2007 and got Extension until June 2013. My Solicitor thought that we can apply by using this theory and informed me that I can apply 28 days before of my entry clearance which means I can apply 08/06/2012.
In some cases, applicants may have been granted five years continuous leave, but will not have spent five years continuously in the UK before their current leave expires. Caseworkers may count the period between entry clearance being granted and the date the applicant entered the UK towards the five years, provided this period was not longer than three months.
Now lots of my friends has told me that I do not qualify for this since my visa was extended if my visa expires on 03/07/2012 in that case only I will be only granted the visa.
Please can some one help me and let me know as my appointment is already booked and I am very worried that if they refuse me I am going to lose my all the fees.
