ILR UK entry Gap

Hi,
Could anyone help me with this info.

I had my visa stamped with HSMP on Aug 5th 2007 and I entered UK on 1st Oct.
Now on TIer 1 which is ending on 5th Aug.
I was out of Uk for around 60 days all these years.
Can I apply for ILR directly now or should I get a short extension and then go for ILR.
UKBA mentions that we have to go for extension if we are a few weeks late after visa stamping. I am around 8 weeks late.
It would be additional trouble if I have to extend again.
Please advice.

There is a concession for those who arrived up to three months late and, having been granted five years leave, are unable to complete their residence period. You can apply 28 days before August 5.

Why would you want to contact home office?
