ILR application and wife was away from UK for 6 months

Hi,

My situation:

Me, Tier 1 general, valid till Feb 2013. Came to UK in Mar 2008, so eligible for ILR in Jan 2013.

Wife - Tier 1 Gen Dependent, valid till Feb 2013. She entered UK in Jul 2008 and we are staying together since then. But she had to visit india for maternity for 6 months, from Jan 2011 till Aug 2011.

Child - Born in india and is on Tier 1 dependent valid till Feb 2013. Came to UK in Aug 2011.

Now, I am trying to find out if we all (me, wife and child) can apply for ILR in Jan 2013? Or Wife and child not eligible? While my wife was away, I still lived at the same house and have joint name on council tax, electricity and rent agreement. I guess that wont help much as she was not here.

Any help with this will be greatly appreciated.

Your wife should be ok to apply with you and your child too..

Thanks, but a friend of mine told that before applying for my wife's ILR, she should have spent 2 years in UK from the date of application. Thats what is causing bit of worry for me.

I see not problem with your wife's application. Go ahead and apply for ILR together. When I applied, the CW did not even look at the absences for my wife on her passport but just checked the cohab docs.
