I am writing this on behalf of my friend who need help from members of this forum.


Could please help me in preparing the documentation required

Date of entry to UK on 27th Sep2002 and I am eligible to apply for 10 year long residency on 30th Aug 2012

Student Visa 3years 2 months
Fresh talent Scheme (FTS) - 2 years
Work Permit 5 years ongoing
I have been in country all the times with valid visa and not have any gaps.

Due to restructure in my company there are compulsory redundancies occurred and I have been given a letter of exit on 31st Dec 2012. My current work permit expires on 9th November 2012 (under 5 years WP) so it will be a problem for me to get letter from company to say that my employment will be continues after ILR granted. And because of this reason I am thinking to apply under 10 year’s route.

To apply for ILR under 10 year category few points to be clarified.
- Do I require a letter from my present employer confirming that I continue to work for a foreseeable future?
- I have continuous 95 days out of country during my studies in 2005 under student visa (attended software training to get dissertation done) - will this be a problem?
- My wife is on dependant visa from past 4 years and I have Kid (1 yr born in UK)- what is the minimum maintenance fund I have to show.
- Can my wife will able to apply together with me under 10 years application or she needs to make separate application?
- I am assuming that I can register my son for British citizenship if my application is approved as he was born in UK?

I really need help for this matter. Your assistant in this matter will be very helpful.

In your wife's case, I would that your wife does not apply for FLR(M) until near to the expiry of her current leave. If you are granted settlement before 09-Nov, she may be able to apply for settlement directly without having to switch to FLR(M).

We had a look at guidance for long residence and set O form but could not find any details with regards to employer letter. And because of that reason I am not sure whether employer letter will be required or not?

I have my last 6 years P60s and all payslips with me but company won't be giving letter in support of my ILR application.

In your wife's case, I would that your wife does not apply for FLR(M) until near to the expiry of her current leave. If you are granted settlement before 09-Nov, she may be able to apply for settlement directly without having to switch to FLR(M).

Rule of thumb - Anything not listed as requirement in the policy guidance and the application form and the immigration rules is not a requirement.
