New Immigration Rules - Query about my wife qualifying time

Dear friends,
I am on old work permit (2007) and am due to apply for my ILR in August 2012 with my wife as dependant. However, I have recently discovered that UKBA has introduced new family immigration rules which extend probationary period for settlement for spouses from 2 years to 5 years. I just want to know if this rule applies to me as well or being on old work permit, I am ok to show 2 years cohabitation documents for my wife and apply for her ILR?
I am not too far from my application and would really appreciate your speedy reply.
