Early application for ILR based on 10 year long residence

Hi,
I have currently applied for an extension of my student visa and I would like to vary this application on the grounds of ILR based on 10 year long residence. I believe I can do this only 28 days before qualification. However, I would like to vary it about 38 days before qualification. If I do so, would it be refused? Or will these 10 days be eaten up while the caseworker considers my application and before he could make a decision I come within the 28 day rule?
Anyone with any info regarding this, please advise!!!
