ILR Questions

Hi
I got My HSMP VISA on april 2008 and I landed in UK on June 2008. I had my visa extended successfully in April 2010.
Since I am eligible for ILR next year, Do i have to first extend my HSMP in april and then apply my ILR in june OR Can I apply for my ILR directly in April ?

Hi
You can directly apply 28 days before the 5th aniversary of your HSMP for your ILR in April as you've landed with in 90 days of your HSMP being granted to you.

If the difference in your Entry clearance date and entry date is not more than 90 days then you will apply for ILR, otherwise, you will go for an extension.
Judge yourself...as you have not given the exacts dates....

Thank you very much for the response.
I got the Visa on 08/04/2010 and entered UK on 13/06/2008. This will be around 65 days.

Hi
Following the information what you've just provided in your recent post you can apply directly for your ILR 28 days before the 5th Aniversiary of your HSMP you dont need any more extensions till June.

As mentioned by Smam, you can apply for your ILR after 25/02/2013 which is 28 days before your 5th visa anniversary.

Thank you all for the quick response.
Does Council tax receipts a must for ILR? As from past 4+ years my bills are included in the rent i pay to my owner.
I am registered in the council and i vote in every election. I do not have any employment gaps. I do have P60 forms for all 4+ years.

Hi
Council tax has got nothing to do with ILR neither your registration has got any thing to do with your ILR neither this thing has got any thing to with your ILR if you vote every year or not.
Yes your P60's are definitely important documents and I would advice you to keep them safe with you as you'll definitely need it at the time of application for your ILR.

Thanks for the response once again.
My wife is on my Tier 1 general HSMP dependent visa.
Next year when I apply for ILR, will she be my ILR dependent OR can i apply her under normal ILR ? Does she have to meet 180 days criteria ?

What's the exact date your wife has joined you in the UK as your dependant.
No the 180 days rule doesn't apply to your wife for her ILR application.

My wife was with me since the day i landed in UK (June 2008). But within this 4+ years she is away for almost 175 days.
1) Now she is planning to go to india along with my baby for around 30 days. Is this fine?
2) Since my baby is born here in UK is she eligible for UK citizenship once i get my ILR

Yes its fine..Out of country rules doesn't apply on dependent but when she will go for citizenship make sure she hasn't been away for more than 27o days in last 5 years.
Yes your baby will be eligible for UK citizenship once you get ILR

apply for your ILR first. After you get it then apply for naturailisation for your baby
