Hi

After getting TIER1 visa I entered into the country after 94 days. My current Tier 1 visa is due to expire after completion of 5 years.

It seems the rule says that the case worker will consider the ILR application for any delay upto 90 days for the entry into the country .

As mine is 94 days, will they consider my application if the dealy becasue of valid reason. Please help if some one had come accross same situation.

90 days appears to be a stated threshold. What makes you think it's negotiable?

As the difference is minimum and for valid reason. Was checking if some body had similar experience which can help me to decide the next step.

Reasons are valid if they are stipulated in the IDI's and guidance. Your reason, whatever it may be, can't be valid if the IDI does not state that it is permitted to use this reason in conjunction with a request to extend the limits of the 90 day late entry concession.
