ILR for PBS dependant

Hi...
I am on Tier 1 Dependant visa.
First came to UK in Dec-2007 as HSMP - Dependant.
Extension as Tier 1- Dependant on Oct-2009
Now ILR is due in Oct-2012
Continuous stay in UK since Dec-2007. No gap in between.
But due to new rule, there is some confusion. Should I apply for ILR or FLR with my spouse application?

Stamped HSMP in Oct- 2007
Extension as Tier 1(gen) - Oct -2009
Now due for ILR in Oct -2012
Any Advise/ Suggestion / Experiences ?
