postal application?

Dear all
I have posted here before.I am a tier 2 general migrant.I switched from workpermit to tier 2 in August 2009.My leave to remain for workpermit was issued on the 31st oct 2007.My leave to remain for tier 2 expires 13Oct 2012.I was told by a board member that since I can apply 28 days before leave to remain expires, I can make an application either in person or postal, on 3rd oct 2012.I was very happy until i saw this today
Technically speaking you will need to have valid leave to remain to cover the entire 5 year residency for ILR, even though you can apply upto 28 days before visa expiry
where does this leave me?should i make a postal application?i just cant wait so long as I have a daughter at home and want to get her back asap.

Just received message from UKBA settlement policy team.
As long as I apply during 28 day period before leave to remain expires, the case worker will not take shortfall in consideration.
leave to remain: 31 Oct 2007
leave to remain until: 13 Oct 2012
I was worried about 18 days short, but I can apply on 3rd Oct 2012.
