Query regarding dependants eligibility to apply for ILR

I am a resident in the UK with a work permit visa for 5 years (2007-2012).Having completed 5 years, I am now eligible to apply for ILR (Indefinite Leave to Remain). However, I have a query whether I could include my wife and child who currently are dependant on my work permit visa. I have the following in order to give you background information:

Background Info:

Myself:
My visa details: Limited leave to remain valid until 30/09/2012
Whether I qualify to apply for ILR: YES

My Wife:
Wife’s visa details: Visa to join spouse/CP valid until 30/09/2012.
Date of first entry: 24/08/2008
Dates of absence:
From 23/02/2010 To 10/04/2010
Reason of absence: Family Holiday to India
From 21/07/2010 To 11/12/2011 (Total 17 months)
Reason of absence: Maternity. Delivery of our baby and child care.

My Child:
D.O.B: 15/01/2011 (Born in India)
Date of First Entry: 11/12/2011
Childs visa details: Work permit dependant valid until 30/09/2012

Please can you let me know whether my wife and child are eligible to apply along with me.

NOTE: I WILL BE TAKING AN PEO APPOINTMENT FOR ALL 3 of us.

Can anone help please? I have seen that morethan 65 people have viewed my query and sorry to say not even one has replayed. I had been to this forum with lots of hope. please if you have knowledge regarding my issue please help. I have called home office but could not get a proper answer. Now my only optio would be to spend £200 and book an appointment with a solicitor for initial one hour. I have read the questions and answer posted here and they are really very informative. I have asked many people who have given me conflicting information. so if you know my answer i will request someone to help with my query please. may god bless all. cheers
