I was qualified for 14 year on April 2012, which mean before enforcing the new rules. I still have my discretionary leave till October 2012. Could I still apply for the for 14year long stay. I am late to apply :(

Under the new rules, at least 20 years’ continuous residence in the UK, lawfully or unlawfully, will generally be required before a person can then apply to start a 10 year route to settlement in the UK on the basis of the Article 8 right to respect for private life. Anything less than 20 years’ continuous residence will generally be insufficient to establish private life to the extent that it would be unlawful to remove the person from the UK. The criminality thresholds set out in the section below on criminality will apply.

yes I understand the new rules, but my question is, in my case the new rules enforced on 9th july, where my ligbility for 14 year was in april, so it is before the new rules.


I went to see my solicitor in April (I m getting help from organisation that help people to apply) and he said will apply on September, before my discretionary leave expires. so it wasn’t my fault :(

You should have acted sooner. You did not apply before July 9 so can't avail yourself of the rules that were in place then.

He's too late; the rules changed in July. You are now looking at 20 years; no other options.

The only other option is to see if you qualify for 10 year route. It would certainly help you going forward to check in this forum regularly (at least weekly).
