Query in Set O and 3 monts grace period.

Hi Seniors,

Thanks for this forum, you people are doing great job. I have three questions, kindly clarify please.

Visa Granted = 17th Dec 2007
Entered in UK = 8th March 2008
Total delay from visa grant date is = 83 days (Less than 3monts)
Outside UK = 110 days.
Visa expire date = 17th Dec 2012


Questions
1. Will I be eligible for ILR after Nov 20th this year, as per the rule (“Indefinite leave to remain – calculating continuous period in UK” 3 months grace period. “Applicants may have been granted five years continuous leave, but due to delayed travel will not have spent five years continuously in the UK before their current leave expires. Caseworkers may count the period between entry clearance being granted and the date the applicant entered the UK towards the five years, provided this period was not longer than three months.”)

2. If I am eligible to apply ILR in Nov, what should I answer to this question in set o (Section 9 “Please confirm whether you have spent a continuous period of 5 years lawfully in the United Kingdom”) as I have completed only 4.8 years in UK.

3. If I clear Life in UK exam now, will that be valid after the new pattern for Life in UK exam.

YES for question 1 and 3. Not sure about question 2. I am assuming it will be an YES as well :) some one who already got ILR can confirm this. Good luck.

Hello Satya... as per UKBA you need to apply when u reach 28 days for your visa expiry.. that means calculate 28 days back wards from expiry date.. on that day u must have valid visa covering 5 years of legal stay from entry clearance day.

in your case you entered uk on 8th march 2008 so u will be eligible for PR by 7th March 2013...so calculate 28 days back wards... on that day if u still have valid visa u can apply for ILR.. else u need to go for FLR

pls take expert advice or call home office direct... i did it in my case...

keep posted what u conclude...
