HI everyone

I have been in UK since feb 2003 work permit and now tier 1
however i was working outside uk from nov 2007 till october 2009 even though i visited uk
very often there are breaks for more than 90 days so i didnt apply for ILR.

since May 2009 i have not gone out of uk, my company
is planning to transfer me again to europe... by reading the posts it looks like i will
not be able to apply for ILR in may 2014 if i go out of uk again for work...
is there any other way that i can apply for ILR?

i will be based in france and i can come to UK every month for the weekend, yet i think
i shouldnt be outside uk for more than 180 days in total for 5 years isnt it?

have anyone came across similar situation as mine....i have lived in UK for last 9 years
but still cannot apply for ILR because of the absence rule....

i am confused any help is appriciated

Could you qualify under 10 year (long residence) route in Feb 2013? Much easier documentation-wise, but different absence requirements.

If you did apply the 10 yr route, you would be without your passport for (currently) 6 months or so.

Hi wpilr

Thanks for your quick reply, even if i was absence for around 20 months can i still apply under 10 year rule??? out of the 20 months of absence, I have been to uk for about 6 times on short
holidays (1 to 2 weeks each time) but most of the period i lived outside UK because of work between 11/07 to 05/09.

Your days outside of UK are made of complete days, do not include fly-out and fly-in date. Work out the total days.

From UKBA website, get guidance for 'Long Residence Settlement', that should answer most of your questions. Link below

Hi All,

I'm an engineer working in offshore on regular rotation 4 weeks OFF 4 weeks ON. My absence from UK makes more than 180 days per year, however, I've never stayed more than 45 days out of UK in one trip. Can I apply in person for ILR as a straightforward case or not?

If the person traveled through any UK airport (in and out same day), will it be considered as a day in UK?

Thanks in advance
