ILR Q

Hi

Could you please advise on below points

1) I: entered UK on HSMP Jan 2008 , renewed T-1 Oct 2009 due for ILR in Nov 2012--------------do I need to use SET(O) form ?
2) Wife: entered UK Aug 2011 Tier-1 dependant via valid until Jan 2012-------------as I understand because she has not completed 2 yr so she is not eligible for ILR application with me (right /wrong)????
3) Wife: If she cant apply for ILR which visa category she will fall into and which form ?
4) In SET(O) SECTION 3 - WHICH CATEGORY? Do I need to select Tier1 General in section OR Highly skilled migrant in section B ?

Can you advise on above 2 as Faq suggest FLR(M) but is for Partner of a
person present and settled in the UK. I would be making both application at the same time so I am not considered settled am I ? so is it FLR (M) or (O)

yes she is dentist but has not yet cleared exam here.

In such case, the possibilities:

1. If your application is approved the same day, your wife may apply for FLR(M) in person the same day.. To do so, you will need a separate appointment for her FLR(M) application (with some time difference between your and her appointment). Or she may apply at any other day at a PEO.

2. If your application is approved the same day, she may choose to apply for FLR(M) by post any day before her current leave expires.

3. If your application is not approved on the same day and you do not get a result before her current leave expires, she must make a FLR(M) application by post before her current leave expires.



As for the SET(O) form, read section 3 carefully.
