eligibility for 10 years??

Hi

I am currently on work permit tier 2 ICT .I first came in this country

1)4/04/2003 left uk 28/04/2003 on business visa.

then I came back in 3/09/2003 to 15/04/2004 tier 2 wp. (after gap of 4months)

then I came in 03/10/2004 to 1/09/2005 tier 2 wp gap of (after gap of 5 months)

then i came back 20/11/2005 to 27/05/2006 tier 2 wp (after gap of 2month)

then i came back 15/01/2007 to till date (after gap of 7 and half month)

so in my stay I have gap of 4months+5month+2month+7 months+every year 1 month holiday.

In total I have gap of 729 days.I know its more than 18 months and also one time there is gap of more than 6 months.

My company has said they will not support ILR at any cost.I am eligible for 5 years but because employer is not ready for letter I have to think of 10 years.

Its really frustrating for me as company is not ready for ILR.

Can someone suggest if I can apply for 10 years Near March or not.

I can get letter for illness in that gap of 7 months but I am afraid cant provide the letter from employer.

Since 2003 I am with the same company.

Please Advise

Since which year have you been taking this "every year 1 month holiday"? How many months does this make up in the last 10 years?

And what will this "letter of illness" state? Will it certify that you were so indisposed that you were not allowed to travel? And that the illness could not treated in the UK?

This long 7 months gap was as my wife was expecting and she went to see the family,In home country( in her 21 st week) and thats when complications started and was advised bed rest. so I had to flew back home .As my wife is only child and my in laws are old and were not able to shuffle between home and hospital
For this I can produce letter from her doctor.

Advised bed rest in the hospital for 7 months? Can you provide evidence that she needed full-time carer during these 7 months and that you - and no one else - could take on that role?

If you can, then you may have a chance.

Thank you for your reply.yes I will get a letter from the doctor.Do I need to get reports or just the letter from the doctor will be sufficient?? Plz advise.

No one here can tell you what may or may not be sufficient. It is up to you to provide evidence(s) to support your claims in an effort to ensure that the caseworker is convinced enough to apply discretion in your favor.
