Eligibility for ILR

I came to the UK as a student and changed to HSMP in Dec 2007. I applied for extension under Tier 1 in 2009 and it was refused initially but later granted in June 2010 after appealing. Please, I would like to know if I MUST apply for ILR by November 2012 since I meet the 5yr continuos stay or I can apply anytime between Nov 2012 and May 2013? Am asking this because at the moment my salary would not give me enough point before Jan 2013 but I my income would definitely give me enough point by end of January 2013 wich is after the required 5yrs continuos stay and still before my visa expires in June 2013. Please I would appreciate a quick response and a honest way out this situation.

between your refusal and you appeal, how many months were there in between and were you in UK at that time?

1. You should meet the requirements as at the time of your application.
2. You should have an eligible unexpired visa at the time of application ( for an 'in time' application)

Thanks for your reply brian78. To answer your question; I have not left UK since I was granted HSMP visa in 2007 and I have always applied before my visa expiration. The appeal took six months to come through.

I guess you are saying I can apply at anytime as long as I meet the requirements and my visa has not expired.
