ILR application for Spouse who has got Independent Tier 1

Hi,
I am on Tier 1 visa from June 2010 expiring in May 2013. I got my visa in March 2010 & I got married in May 2010. My husband is on Tier 1 visa and eligible for ILR in April 2013. I came to UK after marriage in June 2010 and we have been staying together for more than two years now.
Can I apply for ILR with my husband in April 2010 on the basis of marriage and staying together for more than 2 years even if I am on my independent Tier 1 Visa which is expiring in May 2013.
