Tier 1 Dependant < 2 years - Can I Apply ILR

I am a new joinee to this group and would appreciate if board members could answer me on my question below.
My wife is in Tier 1 general visa and entered the country on Feb 10 2008 and got entry clearance on Jan 7 2008. Her Tier 1 General is expiring on Jan 07 2013, so based on 90 days rule, since she landed UK before 90 days, she is eligible to apply for ILR before Jan 07 2013.
So we are planning to apply for ILR for my wife and 2 year old baby during mid-December satisfying 28 day rule.
My question whether I (husband) currently in Tier 1 General Dependant can apply for ILR along with my wife and baby. I stay in the country from Jan 2012 along with my wife and baby.
So if we submit in country application along with the primary applicant, is there a chance of getting ILR for myself?
I heard about 2 years rule, but my solicitor said if we are applying together this rule is not valid. Please clarify on this. Also if not ILR what is the visa category that I should apply considering my visa is also expiring on Jan 2013.
