ILR Eligibiliy without tax pay during absence

Hi,

Could you please let me know whether I am eligible for ILR in March 2013?

1. I had got my HSMP visa in April 2008 and valid until April 2010 and came to UK in June 2008
2. In May 2009, I had gone to home country due to personal emergency and came again in Oct 2009 and stayed for 1 month Nov 2009. Due to personal emergency again, at any cost I have to travel to home country. During this period, I have worked in Offshore and salary is paid in local currency.
3. In March 2010, I came UK to under Tier 2 ICT visa. This Visa has taken from home country. Since March 2010, I am in UK.

In year 2009, I was outside of country for 175 days and 88 days in 2010 and tax has not paid. I may not get P60 because I have got UK salary for only 2 months in 2009 - 2010 Financial Year.

Please could you help me for my questions that are mentioned below :-
1. I was having valid visa until April 2010, but I have taken Tier 2 ICT in March 2010 from home country. For ILR 5 year calculation, do they consider from 2008 or from 2010 onwards?

2. If they conisder from 2008 onwards, Will I be eligible for ILR in March 2013? If I produce the reason during absence period under compelling reason i.e. hospital bills, death certificate of closed one's etc...

Need to wait for 'new' rules to be published/effective on 13/12(?) to evaluate your position.
