ILR success - Sheffield PEO

I got my ILR today from the Sheffield PEO. My appointment was at 9:00am and got the results by 12:15pm.

Did you apply from Tier1 or Tier2? Can you detail the experiance and document which you submitted

I was on tier1 - General (HSMP + tier1).
Initial entry clearance: 04-Jan-2008
First entry to uk: 05-Feb-2008
Absences: less than a month holiday + initial 30 day late entry to the uk.

Sheffield PEO experience.
1. Office opened exactly at 8:30am. My appointment was at 9:00am. Initial security checks(similar to the airport security check), Then to the counter-7 to validate your appointment and get a token.

2. Then, there will be an initial check of your application(just a scan through) to make sure you have used the correct application forms, you have all the passports, photos, ...etc. After this, you will be directed to the payment counter to pay the fees. This is where you submit your application + all the supporting documents(originals). I paid using the Bankers draft addressed to the "Home Office"

3. Then you will be called for the biometrics (counters 9 - 11) which takes nearly 10 minutes.

4. After this it will be a long wait(nearly 2 - 3 hours) before the case worker calls your token number to tell you the progress...Then he asks for the photocopies of all the supporting documents.

5. You will be told the outcome of your application ~20minutes after this.

Supporting documents submitted:
1. payslips (12 months)
2. bankstatements (12 months) . e-statements stamped and signed by the bank.
3. letter from the employer
4. Life in the uk test results
5. cohabitation - council tax papers + tenancy papers + spouse bank statements
6. Finances - Savings bank statements.

That's it I think....

Note(1): I didn't have any unpaid absences.
Note(2): I had all my documents(like the marriage certificate, university degree, NARIC letter, ...etc) with me just incase if required.

My understanding is that you can only apply for ILR, 28 days prior to your 5th anniversary of the first entry to the UK..so that should be 8th January 2013.

How come you were able to apply using your initial entry clearance date. or am I wrong in my understanding?

If you entered within 90 days of visa stamp date, and you haven't changed categories, your 5 year begins from visa stamp date.

Q3 - When does my ILR qualifying period start?
There are two scenarios. One is that ILR qualifying visa (e.g. Work Permit, Tier 1, HSMP, etc) was obtained by switching into that category from another visa whilst still in UK. Second is that ILR qualifying visa was obtained out of country. For first case ILR clock starts from the day the passport was stamped with that visa. For second case ILR clock starts from the day when applicant first entered UK on that qualifying visa. E.g. If someone got Tier 1 visa from out of UK on 1st February 2006 and entered the UK for first time on 20th February 2006, then ILR clock starts from 20th February 2006.

I got my HSMP entry clearance stamped from India on 5th Jan 2008 and my first entry to the UK was on 1st Feb 2008 - Got Tier1 extension in Jan 2010. I have only ~130 absenses.

My understanding is that I can only apply for ILR on or after 4th January 2013? I am really confused now. Any inputs?

Your 5 year starts from Hsmp stamp date (assuming you are T1G now), but you can submit your application during the 28 days immediately before reaching the 5 year Mark.

When does your visa expire? That could change things (I have heard).

Considering all facts, events and upcoming Holidays, you are ok to proceed on your current plans wrt when you can apply. But you have to definitely do it before your visa expires.

Otherwise you could count your 5 years from Hsmp stamp date.

There are only 6 working days left before jan 4. So no difference really. But if you can get appointment before jan 4, fine.

Hi Shalondon,

You should be able to apply for your ILR 28-days before your current leave to remain visa expires. As I understand, your current VISA expires on the 20th Jan 2013. so, I think, any date after the 22 Dec 2012 and before the 20 Jan 2013 should be fine.

I'd be grateful if you can please answer a few questions I have with regards to ILR

- How many years worth of evidence is required to prove cohabitation & how many sources are required?

- You've mentioned Savings bank accounts as proof of finances, I'm assuming this is to prove the funds maintenance criteria. Do the funds have to be in a current account (UK) or Savings account funds are acceptable?

- What did you write in the set(o) application form for the question - have you completed five years lawfully in the UK? yes or no. As you applied under the 90 day allowance between date of stamping & arrival.

- What did you fill in the app form question - how many years & months have you been in the UK? did u put 5 years or did u put 4 year 10 months X days?

- Did you explain in the cover letter that you arrived in UK 26 days after VISA stamping?

-You have clearly applied within 28 days of your stamping, how long before did you start looking for appointment?

Please if you can answer these it will be highly appreciated

2 - Reason is ask is because in the application i am asked i.e. do you receive any benefits, so I like to double check that i would say YES or NO there.
