SET(M) Time spent outside the UK vs. Delayed Entry

09/09/2010 Spouse Visa Issued

06/10/2010 Arrival in England (1st Entry)

Total Time Elapsed Since 1st Entry in UK: 2 years, 2 months, 3 days

Days Spent in Pakistan AFTER arrival in England (To visit Mother): 4 months, 17 days

So basically as my visa was for 2 years 3 months, that means given I took 27 days to Enter UK, I can minus 2 Months 3 Days as additional permissible time allowed outside UK.

So that means I spent 2 months 15 days outside of UK AFTER entry into UK.

Am I right?

The Immigration Rules do not say that you must have been in the UK for the entire 2 years of your visa or permission to remain.

If you delayed your entry to the UK

If you were given a visa in this category but you then delayed your travel to the UK by up to 3 months, you can apply for settlement using application form SET(M) shortly before your visa expires.

Now my question is:
  • (1) When will my application be considered? As the time elapsed since I entered UK is 2 years, 2 months, 3 days, that means 2 years have clearly passed. OR will 2 months 15 days outside of UK AFTER entry into UK be taken against me and the application be held for 2 months 15 days after my application date?
  • (2) Is this 2 months 15 days outside of UK AFTER entry into UK in the category of "Time spent outside of UK" or in category of "Delayed entry into UK"?

When it will be processed is anyone's guess. And as said to you in other threads, no point worrying about a posted application.
