Gap of 2 - 3 months between visas

Hello I'm due to apply for ILR in jan 2013

I collected first visa HSMP which was from 17/01/2008 - 17/01/2010.

I applied for the next visa then it had become Tier 1 on the 14/01/2010 before my initial visa ran out. UKBA acknowledged receipt of the application.

On 09/03/2010 ( after almost 2 months ) application was rejected on the basis of not being able to collect payment for the application fee

So I sent back the application on 11/03/2010 (2 days after )and it was approved on 01/04/2010 for 3 years.

My question now is on the basis of completing 5 years from I am due to apply for ILR by jan 2013, but not sure because of the gap between 17/01/2010 and 01/04/2010.

Would that gap count against me or not as I didn't breach the rules at any time ?

Did they gave you an interim period to send your application with correct payment details?

No they just returned the application with a letter that unable to take payment. so we sent it back again with another card

so many different peculiar situations not catered for on the UKBA websites

Technically your gap is between 9/3/10 and 11/3/10. You would be covered by Immigration Rule 245AAA.(a).(iii). But your actual rejection letter would have spelled out the exact terms which would still work in your favour.
