Hi There,

I was granted a work permit for the period – 16th April 2008 – 16 April 2010
First Travel Date/ Entry to UK - 25th April 2008
I was then granted a Tier-1 Visa for the period – 10th March 2010 – 10th March 2013
Eligible to apply for ILR = 25th April 2013- 28 days = 28th Mar 2013

My question is – Does it matter if there is a gap of 18 days between my Tier-1 expiry and my ILR? If it matters then can you please advise how to deal with this situation.

Thanks in advance!

@AnkitaMishra,

You should have been granted leave accordingly to complete 5 years on economic route. But your switch over was 37 days before your WP expiry date.

Your actual gap is 46 days, you can only apply 28 days before if you have valid visa meeting or exceeding your ILR eligibility date.

If your LTR runs out before that you'll need to extend your Leave before you can apply for ILR, even if you extension is under progress you can file application for ILR as variation of leave.
