ILR..... urgency

Hi there,

I am going to apply for ILR in a weeks time.I am confused about few things if some one can help me with it...

1. In new Set(O) form where it ask about criminality..... i am not sure if i need to disclose it or not as per the new rules.... as i had a traffic offence of LC20 (driving otherwise than in accordance with a licence) back in 2008... i was given a PCN by the police officer with a fine of £60 and was given 3 points .... not through court....

2. About employers letter for days out of UK.... i am on old work permit.... do i still required to provide a letter from the employer even though its less than 180 days in 5 years....in my case its around 70 days and all for family visit and were annual leaves.....

3. section asking about ties.... should i need to mention about my tiers with uk too as i have lived here for over 5 years..... or just about my home country....

4. what are the UKBA PHOTOGRAPH GUIDANCE for Set(O)....

i would really appreciate if some one or any senior member or moderators can give me there generous advice on these ASAP as my appointment is approaching fast....

Yes , you have to declare it but you will be fine since it was not through court

Old work permit?? Not Tier 2 or Tier 1? Never knew that is possible. If you are not on Tier 1, you have to have employer letter for all absences I guess irrespective of days outside UK. However, I am not very sure. In case you are on Tier 1, no letter required

It was Fixed Penalty Notice or other?

1-SET(O) 7.2 You must give details of all unspent and spent criminal convictions. This includes road traffic offences but not fixed penalty notices (such as speeding or parking tickets) unless they were part of a sentence of the court.

2- new rules on 13 Dec 12, FPN will be neglected if you got it more than 24 months from the date of application.

so you don't need to declare it.

n sorry my bad its PCN...... Not FPN.... as u do not get points on FPN...

thanks for ur reply.... work permit was the category before PBS.....

Sorry, missed your comment above. Choose Solihull PEO, a few people gave good feedback on staff working there being helpful.

There are a number of posts/topics coming up when you search for LC20, it could help.

A penalty charge notice (PCN) is a type of Fixed Penalty Notice used to chase non-payment fines using civil action. The only difference between these and a Fixed Penalty Notice (FPN) is that a FPN can lead to criminal prosecution if not paid.
PCNs are now enforced as a civil rather than a criminal matter and doesn't result in a criminal record or points on your licence.
so why would you need to disclose it as an issue of character at all !!??

thanks for your reply but actually.... in the new form it does say that disclose even road traffic offence ..... but its quite confusing... as they didn't really discribe about this kind of traffic offence n plus this incidence is just under 5 years old. so not sure.... and im a bit stressed out on that ....
