As per dependent rules where one has to stay more than 2 years my Son doesnt qualify this criteria. But he is born here. So does that rule applies to him? NO. Or can I apply for him aswell using the Set(O), on your same form as your dependent?

Just to clarify since there was a question mark next yuor answer;

Qualifying period of 2 years doesnt apply for Minors (under 18) and can apply using the same for as me under dependent,

Just one more query: I am planning to apply 28 days before the current visa expires.

HSMP 18 Feb 2008-18 Feb 2010 , Came to UK 14 March 2008

Tier 1 G - 18 Feb 2010 to 18 Feb 2013

under the section in SET (O) they ask how many years have you lived in UK,since I am applying 28 days beofre my visa expires do I put this as 4 years and 11 months or 5 years?
