ILR Eligibility (outside UK for 90 Days in single visit)

Hi,

I'm in UK from 09-Jan-2008 and currently eligible for ILR (Think so), find my details below and could you suggest any issues applying ILR.

Initially Entered UK in Work Permit on 9th Jan 2008, switched to Tier1 General by 23-July-2008.

Flight Out Flight In Absence per Trip
18-Feb-08 - 09-Apr-08 Total Days: 50.00 (Working Offshore)
11-Aug-08 - 10-Nov-08 Total Days: 90.00 (Working Offshore and Notice Period)
29-Aug-09 - 14-Sep-09 Total Days: 15.00
24-Dec-09 - 03-Jan-10 Total Days: 9.00
28-May-10 - 14-Jun-10 Total Days: 16.00
27-Aug-10 - 30-Aug-10 Total Days: 2.00
24-Dec-10 - 23-Jan-11 Total Days: 29.00
16-Aug-11 - 04-Sep-11 Total Days: 18.00
23-Dec-11 - 02-Jan-12 Total Days: 9.00
20-Jan-12 - 29-Jan-12 Total Days: 8.00
05-Sep-12 - 14-Oct-12 Total Days: 38.00
20-Dec-12 - 02-Jan-13 Total Days: 12.00

Total Absence from Jan 2008 till 07-Jan-2013 = 296 Days

Am I eligible to apply for ILR under the new rule changes (13-Dec-2012) and also will there be an issue of my absence of 90 days during Aug-2008 when I was in WP?

My WP employer is not providing me a letter, I have P60 from Nov-2008 till days, as my salary during WP days was getting paid in offshore.

Your safest bet would be to have a clean UK paid 5 year period. Nov13 application maybe. That way you are not left to justify anything to anyone.
