ILR for Dependents

Hello All,
I have a question regarding my ILR status,
1. I came to UK in Dec 2007 on T2 visa
2. Moved to Tier1 in Nov 2009
3. In July 2011 i went to India for my maternity delivery
4. In April 2012 ichanged my Visa from T1 to Dependent
5. Myself and my son Came to UK in may 2012 with dependent status
6. till date i am in UK with dependent Visa
My husband is on T1 visa from past 5 years , he is getting eligibility for ILR (with 5 years rule) in Feb 2013. My question will
1. Am i eligible to apply for ILR with my husband as co applicant ?
My points will be
1. I was in relaltionship with my husband more than 2 years
2. Last 2 years i have a valid reason which is my maternity to be away from the country, will this be considered by casr waorker
