ILR queries

Hi,

I have two questions about my (Tier 1- G holder) ILR and would appreciate if someone could reply:

1. I came late in the UK by 1.5 months post issue of my EC date so wondering if I could count that period for continuous residence while using SET (O) form. I have understood from recent discussions in this forum that I might be able to!! Please confirm for my case as I switched in-country from work permit to Tier 1 (G)?

2. My wife is living with me since 2011 so she will complete 2 years in 2013. To provide cohabitation for year 2011 all that we have is a letter from deposit protection scheme and 1 No. letter from NHS. Would this be sufficient?

3. My 5 months’ pay will be sufficient to score earning points and I have been changing jobs so I do not have P60. Do I need to provide letter from HMRC?

4. EC was issued on 01/07/2008. Can I apply 3rd June i.e. 28 days rule?

1) & 4) You will be eligible to apply for ILR from upto 28 days before the 5th anniversary from your EC date, as you first entered the UK within 3 months of EC.
3) If you do not have any P60's at all for the 5 year period then it would be worth requesting a employment history statement from HMRC, to provide in the event a case worker asks for it to prove that you were economically active during your residence period. (Note that I'd expect you to have at least a few, even if you did change jobs. They are issued at the End of each financial year by whichever employer you are with at the time). This is not a requirement, but some case workers are known to have requested these, so you may be better prepared if you have it with you.

Please could you advise on cohabitation issue as well. Lack of documents for year 2011!!
