Hi, I have applied for ILR as dependent spouse for my husband who got his ILR on long residence basis (10) years. I have been in UK for 6 years, then went back to my home country for about 3 years, during which I came back for 2 months, then I'm back in the UK from 2010..did my biometrics in December. I recieved a phone call from the UKBA asking for my Life in the UK original certificate, as he couldnt find it, he found only the copy. Then he checked his database and found out that I did take the test in wolverhampton. Then he told me ge'll send me aleeter, which I recieved today asking for my previous passport(which has the stamp and visa for my first arrival in the UK), also aked for my immigration history and absences from UK. I have renewed my visa twice by post when I wasnt in the UK, as we called the home office and they confirmed that it could be sent by post from the UK, as no biometrics were required at the time.
My worry is why they are asking for my old passport and immigration history.

Could anyone please help, I'm getting nightmares over this

Only they would know the exact reason to be honest. However, my guess would be that need ascertain if you have co-habited with your husband for the required time.

I wouldn't worry too much and send what is requested.

The only other reason could be that they want to check your entry n exit dates. They have your entry dates on their system but not the exit dates. But again not sure how it's relevant to your case. True, only they would know that

I know that they're the only ones who would know, but I was just looking for some reassurance.
As for the cohabilitation with my husband, the SET(M) is based on the last 2 years, for which I have provided evidence.
The entry and exit dates wont show my cohabilitation.
I will of course send what is required, I have no other option.
Do you think renewing my visa when I wasnt in the UK, could cause a problem, eventhough I didnt breach any law, they had renewed it without any problems, they knew I wasnt here (from the dates in my oassport), I was also asked on my entry at the airport how I renewed it, and I told the lady by post, and she let me in.
I dont know how I am going to be able to wait until this matter is sorted.
Any other feedback will be much appreciated.

They just would want to check how many days you have been in and out of UK. That may or maynot have any impact on their decision.

also renewing your visa from your home country shouldn't be an issue.

But why should my absence from Uk matter, if the application SET(M) is only about the last 2 years?

I agree with you however, unfortunately each case worker has a different approach so all you can do is send the requested docs and try not to worry too much as you cant do anything except worrying.

Asking for your previous immigration history and absences letter plus old passport, there is a high chance it's related to the entry and exit dates. As mentioned earlier, though it's not relevant but still each caseworker assess the case in their own way. If you don't think there is any discrepancy, you shouldn't worry. Goodluck

I doubt that they were aware that you were not in the UK when they decided your previous applications. You are required to be in the UK to make a valid application for leave to remain so i am not sure why you were advised otherwise.

I was in the UK when I applied for ILR and I did my biometrics as well.

yes, I think he misunderstood me.

no, he thought I applied for ILR when I wasnt in the UK , HE SAID (You are required to be in the UK to make a valid application for leave to remain)

i didn't misunderstand you. An application for 'leave to remain' refers to an application for limited leave or indefinite leave. You are required to be in the UK to apply for leave to remain (ie further limited leave or indefinite leave)

but when we called the home office, told them I was abroad, they said I could send my passport and application by post, as no biometrics were required.

Since they have requested to send your OLD Passport and Immigration History. You must do it with out delay. We do not know for what purpose they are asking for. May be to see E ntry/Exit dates..

Also another point about my absence, it was shown by the stamps on my passport that I wasnt in the UK when I sent it for my previous visas, so why didnt they object to it?

I'm just worried sick about this...especially that the SET(M) is only about the last 2 years only.

Ive sent my old passport too. i had too many absences here in the Uk.

My advise is for you to send what they have asked for immediately. More you delay ,they will think You are trying to hide some thing.Until they get this information they will not process the application.

You worrying about the past is no help .Just send your Old Passport and Immigration History as soon as possible. Keep a photocopy of of both with you to answer, if there are any more queries from UKBA.

Applied for FLR-M but getting nervous coz of absences.

were they requiring the absence history in the application form?

yes they will i dont know. i had too much absences!
