Single absence of 125 days outside uk

Hi,
I would be completing 5 years in UK by end of Feb 2013. I came on work permit in March 2008 and got my tier 1 visa done in May 2009. I had a single absence of around 125 days out of uk ( 1st MArch 2010 till 3rd Jult 2010) . During that period, i worked from India for 2 months ( for the same employer) and then from Zurich for next 2 months. My total outside UK stay is less than 180 days in last 5 years.

I do not have employer letter to justify that this 4 month gap was work related. As per the Dec rule , i understand that as an tier 1 applicant , i am not required to provide that letter !


Also, is there any preferred way of making the application ? Would applying through post have better chances of success in compare to in person ?
Is there a preferred PEO to to apply who deal with cases like mine in better way ?

Also, is there anything that i need to explicitly mention in cover letter regarding 4 months gap and unavailabilty of emplyer letter ?

Looking forward to valuable input from experts and thanks in advance.

Why is that you cannot get an employer letter....they are obliged to give you one.
However - from what I read...you should be okay. But you should stuill get a letter from your employer for the period you were on WP (the below link will help you understand)

Thank for your reply Deepak. I was on Tier 1 visa when i had 125 days of break.

Also , i was with india based company when i had this break and deputed to UK . They provide letter which is more of depuation letter and they are not ready t ospecify the exact dates in the letter.

Amit - did you not travel outside UK when you were on WP ? If yes - then you need to get one (thats what the policy doc says)

The policy guidance says - you do not need to provide reason for absence if you are out of the country for less than 180 days on Tier 1. However there is another statement that says any medical or compassionate leaves needs to be stated and evidence should be provided.

If you go by the policy - you should be okay. However, if the CW needs to know why you were off for 125 days - you might need to have a valid reason that....see topic below
