ILR Urgent Help Required

Hi All friends / Gurus
I am applying for my ILR end of Feb ,now there are few things needs to be clear.
History
Currently holding tier 2 general visa valid till end 2014. Entered on work permit which got extended 2 times .Working with same company from last 5 yrs.
Last year Oct i have got extension for my tier 2 visa.
Now since i am applying for ILR through Some lawyers they asked me for 4 yrs P60 . out of which i have lost 2 which my company was ready to give me again , same time i have asked hmrc for employment history and i was shocked to hear from them that they don’t have my employment history.
I am getting paid in uk and my salary comes directly online via companies account. I am getting proper salary slips and have received all p60 end of year.
My company has got few more employees.
Now questions :
1).What will happen to my application if home office checks with hmrc and they will say they don’t have my employment history. Do they check all 5 yrs history with HMRC.?
2).will my salary slips and bank statements will be not sufficient to provide my employment.? I have 2 P60 as well.
3). If I don’t have employment history how did I got extension every time .?

Please call HMRC . They will send Employment History(what ever they have in their records). .,with in 2 weeks. I hope you gave all the information correctly.
If you go for a PEO appointment some times they ask for P60s
UKBA checks with HMRC, if your application is not a straight forward one they might check.

Why are you going through Lawyers?? Your company can give P60s only once. You are suppose to keep that carefully. No copies can be given.

Something here doesn't add up. P60's are issued only once by your employer, unless you have online payslips and p60's in which case you can probably print them out & get them certified.
If you were legally employed in the UK and paid income tax, NI etc... you will have an employment history with HMRC, this is a fact.

When applying for ILR under an employer sponsored immigration category, some caseworkers are known to ask for P60's (or HMRC employment history) to verify that you met the terms of your WP/T2 visa & were economically active throughout the 5 years.

Company have copy of P60 which they are ready to provide .But why is there no history of my employment ?

Without mentioning company name, would you classify your employer/company as 'honest' or 'shady'?

They r one of the top company so far in there profession . We all together 6 people work for them.Out of 3 have already issued there ILR as well .So i cant say they are shaddy companies.But what they do internally i dont have any hint

Ask your employer if they can issue copies of previous months/year payslips, stamped/signed for certification. This should be acceptable, but bulky.

I have all orignal pay slips from last year . The only thing is missing P60 for year 2008-009.

Then just request the payslips for that year (2008-2009) & take them along with your 4 P60's. If any of these are copies then get them stamped and signed by your employer.

Mate, If your company is Top Company surely they must be doing things right and correctly..Where HMRC is concerned. 3 of the Guys have got ILR.They can guide you., So why worry! Is every thing alright or not ,You will only know the truth.

Seriously speaking we work for them and get paid .I don’t know what they do inside to save there taxes

, , I am only concerned about is my ILR . That why I want more opinions’ from senior people and guru, that what are the chances of my refusal if they home office checks with hmrc and they not able to track my data, though I am applying with all documents required by them . Its costing me nearly 3k for everything so want to make sure before I make my application.

You have to sort out your missing P60 with HMRC,only . Other wise ask your Payroll dept. to give you the Payroll summary for the end of the year. It will have all the Employees names and salary details. Will they give a confidential document to you??
Whether UKBA will check with HMRC how could anybody tell definetely.

Agree with Kevin that no one on this forum will be able to tell you whether the UKBA will contact HMRC to verify your tax records or not. IMHO, it would really depend on how satisfied they are with the evidence and documentation you provide. Personally, if it were me, I would want to find out why HRMC have no record of the taxes, NI I have paid over 5 years, irrespective of whether it were required for ILR. As I said before, something really doesn't add up, if they say they have no record of your employment over the last 5 years! I would personally try to request your employment history again, following the thread below to see what happens.

Contact HMRC and ask them to send what ever records of you,they have in their system. The information is year wise. You should receive with in 2 weeks.Then you could check with your P60s and ask your Payroll Dept.about the missing figures.Explanation!!!
UKBA will check with what ever Dept. they want, if they feel your application warrants further checks.
You are spending 3k for your Solicitors,surely they should give you good professional advise.

How can HMRC say that they don't have your Employment History.???
Please don't go to tell your Solicitor of all the advise you have received in this forum ,They will try to use these advises to earn some more money from Clients, who are not aware about .Try to sort out all your documents, and then speak to your solicitors.You could get your Fees reduced.
