ILR

Hello,

I just been in croydo HO regarding my ILR then the case worker gave me letter and it said on it to bring the employment history from 2008 to date.I called HMRC about my employment history and i seen on it Im working in TESCO as a deputy manager and i can see the detal on employment history but i worked 4 months in other company as well this to get my earning point but on the employment history it doesn,t show any records.I alread submit the pay slips as well.So my worry is has HO alerady checked it by them self and after submiting employment,HO will refuse my ilr due to records shown in the employment history?

please reply me if anyone having any idea or facing a problem like me.

could you please let me know how you calculated your earnings (summary) ?

i am in the similar situation like you ,

i have worked with 3 employers for 2012 and 2013
here are my summary

March/2012 To September/2012 = 27 K per annum worked as a senior software developer

April/2012 to May/2012 = 3 weeks of contract job on my own with the partnetship with contract agency on my own hrs while i was doing my full time job and i have earbed = 250 pounds per day (job title : contract software developer)

October/ 2012 to up to date == 34 k per annum (job title: software eveloper)



actually i am going to include only my full time job as my earnings , and will not include my 3 weeks contract job . will this going to be a problem for me ? i am on HSMP + Tier1

It seems you didn't pay tax on your 4 months earnings hence hmrc doesn't have that information. At the earliest pay the tax and get a letter from hmrc if you want to claim the points for earnings.

Did your employer deduct the tax from your gross salary?

Uksettlement , that's a blunt statement from you saying that is fault of OP. It might be the case where employer didnt pay the tax.

Unless you are a self-employed person, it is the Employer who has to pay the NI,PAYE to HMRC,of his Employees.. I don't think an Employee could Pay these statutory deductions directly to the HMRC.

Re read my reply I have said it seems so it cld be that the employer hasn't paid taxes but the fact is to get this sorted OP will have to take steps. True employer deducts tax but since this was a contract job it was the duty of OP to have made sure the tax was paid.

thanks for the clarification uksettlement , I dont want to argue but I have highlighted where you said You (OP) and how come u came to conculsion that it is contract job as OP didnt say it anywhere ... I will leave it to ur master mind to make ur own conculsions.

So , your clear from your end and its that employer didnt pay the tax , I would advise to speak with HMRC and send the proofs that the tax and NI was deducted from your side and then they will take it with the employer . to make things bit from your side , contact the employer (if they exisit) get explanation why this happened , if that employer is not trading now then you ur application might get rejected and you will need appeal on the grounds that your not at fault.
