ILR Assessment

Hi All,
Since some of you would have had knowledge/experience in ILR process, I hope you may be able to help assess my ILR eligibility for both myself and my dependant spouse.

My Details - Employer sponsored

Work permit - 06/10/2008 to 06/10/2009 (UK 1st entry 12Oct08)
Residence permit (ICT) - 21/10/2009 to 07/10/2011
T2 ICT Long Term - 14/10/2011 to 08/10/2013

Absence History - 01/08/2009 to 31/08/2009 (30 days) Annual Vacation

My Dependant Details

T2 ICT Long Term Staff Partner - 18/11/2011 to 08/10/2013 (UK 1st entry 27-Dec-2011) Total - 1 Year 10 Months 20 Days

Absence History - 10/11/2012 to 09/12/2012 (30 days)

Both I & my dependant have LIUK test pass certificate.
When can I & my dependant apply both apply for ILR together? Can we apply only in 2014 to be eligible for together application?

Hello gurus,

Please help in confirming the assessment.
I am looking to apply ilr prior 28 oct rule change whilst my dependant would not be eligible before 2014.

I need advice what details in section 1 will need to fill in set o in case my dependant applies separately next year?

Apply by post (self & spouse) no earlier than 28 days before 08-Oct.-13.
If you apply at a PEO, the chances are that a caseworker may tell you that your wife is not eligible because she has been in the UK only for about 1 year 9 months.

You can do either, but applying by post is a safer option.

If I and my dependant apply together on 20 Oct, will the case be successful?

20th Oct because my wife's entry clearance started on 18/11/2011 and according to 28 days rule, will she be eligible on that date?

Note - she entered uk only on 27 dec 2011 i.e 40 days after her issue date.

Appreciate your help.

Hi sushdmehta,

My situation has changed recently and looking for advice from yourselves.

I've now extended my & my dependant's Tier 2 ICT visa for next two years.
It means I & my wife are not limited to apply by post as we have valid UK Visa.

Hence my doubt is - If I (primary T2 ICT applicant) change to ILR before 28 Oct rule change, would it mean my dependant's T2 ICT Visa would need to switch from current sponsor to my own PBS Dependant (i.e. self paid)?

Reason I ask is, it seems there are two different forms
1) Tier 2 ICT Dependant which my wife got visa extended
2) PBS (Dependant) VAF10 application form

So does my switch to ILR would mean to change my dependant's visa using form in above bullet 2?
