ILR- 28 day rule

Hi Guys,

I got my initial tier 1 general visa from 27/07/2009 to 27/07/2012. I applied at PEO for extension on the 09/07/2012 and was granted extension from 09/07/2012 until 09/07/2014 (this may be correct as per the UKBA guidelines, but was expecting the visa expiry date to be 27/07/2014)

I contacted UKBA and they advised this is correct and i can still apply for ILR with in 28days from 27/07/2014 (if i apply at PEO i can apply between 01/07 to 09/07/2014)

can i please request if someone can please confirm if this is the case and i will still be able to make in time application at PEO/Postal with in 28days from 27/07/2014 with out falling short of any days

The advice you have been given is correct. If your first application was make out-of-country, then so long as you first entered the UK within 3 months of EC, then you will be eligible to apply for ILR from upto 28 days before the 5th anniversary from 27/07/2009.

Thanks, I made a in country application, so hope there won't be any issues applying for ILR with in 28 days from 27/07/2014

Thanks for shedding some lights on this issue. So for example, if the visa work permit was granted out of country on 20/05/2008 and I entered the UK on 23/05/2008, I will be eligible to apply for ILR any day within 28 days from 23/05/2013?

You can apply ILR - 28 days before 20/05/2013

I'm on a Tier 1(G) visa and have a rather basic question - when can I apply for ILR?

History:
Entry Clearance Stamp: 01/05/09 (out-of-country)
Entered UK: 01/06/09
Tier 1 (G) valid till: 30/05/14

Can I apply for ILR on:

a) 01/05/14 (five years from EC)
b) 03/04/14 (28 days before five year EC – even though my current visa is valid till 30/05/14)
