should I go for a TIER 1 EXT OR APPLY FOR ILR ..PLEASE HELP!

Tier 1 details

17 june 2008 17 june 2009 171 Days
17 june 2009 17 june 2010 37 Days
17 june 2010 17 june 2011 no absence
17 june 2011 17 june 2012 20 days
17 june 2102 17 june 2013 None yet.

I will be eligible for the ILR in May sometime. I read the new rules that are coming into effect from 6th April 2013.

Can someone senior please help me on this if possible.

I switched to tier 1 from student visa so I was already in uk. I went to my country after I got the tier 1 and spent 5 months there..ie 171 days. I was not in job in the UK at that time. I was supposed to go for a month but I was down with typhoid.

My question is

1 . If I go for ILR is the 180 days rule still applicable. I need to provide proof as per the new rule. What proof can I submit here? I had a medical certificate for my typhoid but I lost it and can't find it no where. Will a letter from my self be ok? (* I was not employed at this time)

2. As you see my query..I want to be safe. So please be honest and tell me should I go for tier 1 extension or ILR.

I have tried to draft this email so that the senior member can have a clear picture. I hope I have not missed any information.

Be patient. Am sure you want someone knowledgeable to respond to your query.

Am not yet conversant with the new rules so can't comment on it.

I think you answered most of your questions by yourself. As per the new requirements a personal letter should be enough if you cannot provide the medical certificate or any other certificate. I know this is a stupid requirement and CW will not bother for Tier 1 applicants as there is no requirement that applicant must be employed through out his/her residency period.

I hope Senior Members will explain and suggest you in brief.

I am emphasizing on the word AND here.. So they want a letter from me + the proof..Honestly speaking I never knew this day will come when I have to provide this proof which I have lost. What do think ? I should go for the tier 1 extension. Extremely gutted !
