evidence req while filling section-6 immigrationhistorySET-O

Could you please help me what to fill in the 6.3 ?

I came here in TIER-2 intra company transfer in 3rd may 2008 and switched to tier-2 general in may-2010 to till now.

detail as below

As per 6.2 I filled like

date left the uk, date returned the uk, reason for absence

20-11-2008, 9-12-2008, holiday
13-11-2009, 6-12-2009 , holiday
24-12-2010, 11-01-2011, holiday
04-03-2011,22-03-2011, wedding
30-06-2012, 22-07-2012, holiday
01-12-2012,11-12-2012,holiday

this is basically 19days, 24days, 17days, 17days, 21days,10days respectively.( i.e 19 days(in 2008), 24days(in 2009), 7days ( in 2010), 27days(in 2011), 31days ( in 2012)

6.2 says
Evidence of all work-related absences (including paid annual leave) is required from those applying under Tier 2 (Intra-Company Transfer);Tier 2 (General); Tier 2 (Minister of religion); Tier 2
(Sportsperson); Tier 5 International Agreement, and permitted employment categories - except HighlySkilled Migrants.

however the confusing part is 6.3 which says evidence needs to be provided to support the reasons for all absences from the uk.

1. letter from employer detailing reasons for work related absences including periods of paid annual leave from the uk.
2. letter from applicant detailing reasons for absences due to compelling or compassionate ground
3. original official documents ( medical/birth/death)
4.letter from travel company to evidence disruption to travel
5.other

What evidence I need to provide and how would I get the evidence from the previous company which I left in april-2010 while switching from ICT to General.

From your previous employer you need to get a letter that in 2008.2009 your absence were part of your Annual leave and were with in your leave entitlement. You have to do a summary sheet for those absences.

I spoke to my solicitor and he said that as its in the limit and you have not crossed taking the holiday more than permitted so no need for evidence/document as I've taken only 19 days(in 2008), 24days(in 2009), 7days ( in 2010), 27days(in 2011), 31days ( in 2012). Total 108 days in the last 5 years where I was out of UK.

I wish your solicitor was right, but he's most likely wrong. You'll need a letter even for 3 or 5 days in total over 5 years.

The question is if you had a fight while leaving that company :) then its very unlikely they would give these kind of letter or they would make excessive delay on that. Secondly if the company you have worked before if that got closed then what to do ? Seems there are few caveats on this.

How do you get it ? You have to obviously speak with your ex employers and explain it to them.

If they havent provided it before, there are templates here you could use.
Hope they have the systems to verify this and provide you with this letter.

If you have had a fight with your Previous eEmployer before leaving ,then most likely they will not oblige for your request. In that case you have tp produce documents( P60s, Bank Statements,Payslips) during your leave period. You could write a Personal Note to the CW,listing out your absences. I have read once CW has accepted at Croydon PEO. Always try to get this letter from your previous Employer,before thinking of other means.

Do you mean within the 180 day limit per 12 month period or do you mean within your annual leave allowance?

I spoke to one of my friend who went for ILR on last Tuesday and got success. He was initially on Tier-2 ICT and then switched over to the Tier-1. For section 6.3 What evidence has been provided to support the reasons for all absences from the UK?
he opted for "other" and mentioned pls refer attached pay slips
. However he was having payslip for all the last 5 years. So UKBA didn't ask any question. So I believe on that case there is no requirement for employer letter.
