Hi All,


My wife has been here for 2 years in April 2013 (after arriving on a settlement visa). However, her entry clearance will expire on June 2013.
She is now due to apply for ILR.

However, my financial situation is not great. I have been working for an agency and have not had any work since January. Due to that I am now receiving housing benefit. This is (I guess)classed as Public fund. Do you think this is going to affect the application?

This should be in the benefits section. If you claimed Housing Benefit then a major issue can arise if you are being paid a couple's applicable amount and not a single person applicable amount. Legally your wife should be included on the claim but most importantly she should not be given any benefit (so should be a single person's applicable amount). If you have been paid a couple's amount then your wife is likely to have breached the no recourse to public funds restriction as she is subject to immigration control. If this is the case then she may be refused ILR. Moreover, the income you should have should reflect the income support rate. If neither of you have any income (including savings) then you will likely be refused as you cannot maintain yourselves without recourse to public funds. What other benefits are you claiming, JSA?
